Podcastly is an AI-powered platform that allows users to create, manage, and publish podcasts and episodes. The Service uses third-party AI tools to assist in generating content, scripts, audio, and artwork. We do not guarantee the accuracy, completeness, or suitability of any AI-generated content for any particular purpose.
You must create an account to use certain features of the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. We reserve the right to terminate accounts that violate these Terms.
You retain ownership of any content you create or upload through the Service ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, display, and distribute that content solely for the purpose of operating and improving the Service. You are solely responsible for ensuring your User Content does not violate any laws or third-party rights.

Certain features of the Service require a paid subscription. Subscription fees are billed in advance on a recurring basis. All fees are non-refundable except as required by law or explicitly stated in our refund policy. We reserve the right to change subscription pricing with reasonable advance notice to existing subscribers.
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.
To the fullest extent permitted by law, Podcastly shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, even if we have been advised of the possibility of such damages. Our total liability to you for any claim shall not exceed the amount you paid us in the twelve months preceding the claim.
These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved through binding arbitration or in the courts of the applicable jurisdiction, as determined by us in our sole discretion.
